Short answers: Buyers FAQ
Legal Framework, Ownership Rights, and Step-by-Step Purchase Process in Baku
Azerbaijan, and specifically its vibrant capital Baku, has rapidly transformed into an attractive hub for international real estate investment. With prestigious developments like Sea Breeze Resort, Marina Village, BRABUS Island, and Sabah Residence, foreign buyers are increasingly asking: Is it legally possible for foreign citizens to purchase real estate in Azerbaijan, and what are the rules?
The short answer is yes. Azerbaijan’s legislation welcomes foreign investment and grants foreign citizens almost identical property rights to national citizens, with one key distinction regarding land ownership.
1. The Legal Framework: What Can Foreigners Own?
Under the Civil Code and Land Code of the Republic of Azerbaijan, foreign nationals and foreign legal entities have the legal right to buy, sell, lease, or inherit real estate property. However, it is essential to understand the distinction between building structures and land ownership:
Apartments and Residential Units: Foreigners can own 100% of residential apartments, condominiums, penthouses, and commercial spaces. Your ownership right is officially registered with the State Register of Real Estate (known locally as Kupcha or Çıxarış).
Land Ownership Restrictions: Foreign citizens and foreign-owned companies cannot directly own land in Azerbaijan. If you buy a private house or villa, you own the building fully, but the land underneath is provided under a long-term lease agreement (up to 99 years) or subject to joint share use.
2. Step-by-Step Buying Process in Azerbaijan
Purchasing property in Baku is straightforward, transparent, and usually takes 3 to 5 business days when working with experienced local lawyers and an on-the-ground team like Tevakol.
Property Selection & Due Diligence: Select your unit in premier developments such as Marina Village or Sabah Residence. Verify that the developer holds all legal permits and state registration documents.
Notarial Sales Agreement: The purchase contract must be executed and notarized by an official State Notary in Azerbaijan. Both buyer and seller (or their legally authorized representatives via Power of Attorney) must be present.
Payment via Bank Transfer: According to Azerbaijani regulations, all real estate transactions exceeding 50,000 AZN must be executed non-cash through official bank transfers. Foreigners can open local bank accounts easily with a passport.
State Registration (Kupcha): The notary submits the contract electronically to the Service of State Register of Real Estate under the Ministry of Economy. Under the September 2026 rule, the official title deed (Çıxarış) for a resale apartment is issued electronically in 1 business day; for new buildings, it follows commissioning.
